In December 2025, WG3 UNP and WG5 US PGS addressed the Ministry of Economy, Environment and Agriculture of Ukraine with an appeal regarding Ukraine’s implementation of the decision of the Meeting of the Parties to the Aarhus Convention regarding production sharing agreements.
In February 2026, we received an official response to our letter from the Ministry of Economy, Environment and Agriculture of Ukraine. The Ministry, among other things, notes that the Ministry of Economy has developed a draft order on the approval of the Action Plan to implement the above-mentioned decision.
In accordance with the Action Plan, it is planned to develop and submit for consideration by the Cabinet of Ministers of Ukraine a draft Law of Ukraine on amendments to certain legislative acts of Ukraine to ensure the implementation of international obligations under the Aarhus Convention, in particular the Code of Administrative Procedure of Ukraine (in terms of supplementing with provisions on the immediate execution of court decisions on the provision of environmental information), the laws of Ukraine “On Ensuring Transparency in Extractive Industries” (in terms of providing norms that the texts of production sharing agreements must be provided to the public upon request in full and the texts of agreements must be published before decisions are made), “On Production Sharing Agreements” (in terms of providing that the activities of prospecting, exploration and extraction of minerals under production sharing agreements will be subject to an environmental impact assessment before its conclusion), “On Environmental Protection” (in terms of expanding the participation of non-governmental organizations in obtaining permitting documents).
Representatives of the working groups, if necessary, are ready to participate in the formulation of relevant provisions of legislative acts, as well as to participate in the public discussion procedure after the publication of amendments to the relevant regulatory legal acts. We will continue to monitor Ukraine’s implementation of its obligations under international conventions in order to promote their effective implementation and full compliance.
